Skill4Life Driver Training — Terms of Business

Governing Law: England and Wales

1. Instructor Authority Statement

Driving tuition with Skill4Life Driver Training is a safety-critical professional service delivered by a DVSA Approved Driving Instructor (ADI).

All instruction is conducted in accordance with:

• DVSA standards
• road safety principles
• professional judgement

Decisions relating to:

• lesson structure
• safety during tuition
• readiness for the practical test
• use of the tuition vehicle

are made solely by the Instructor.

The Instructor’s professional judgement is final.

2. Formation of Agreement

2.1 A legally binding agreement is formed when the Pupil:

• confirms acceptance in writing (including SMS, WhatsApp, or email), OR
• attends their first lesson

2.2 This constitutes a binding contract under the Electronic Communications Act 2000.

2.3 This Agreement exists solely between the Instructor and the Pupil.

3. Third Party & Supremacy Clause (CRITICAL)

3.1 Where a Pupil is introduced via a third party (including brokers or platforms):

• that third party acts only as an introducer
• they are not a party to the tuition contract

3.2 Upon commencement of lessons:

These Terms of Business take full precedence over any third-party terms relating to tuition, refunds, or service delivery.

3.3 No third party has authority to:

• impose or enforce refunds
• override Instructor policies
• dictate lesson structure or decisions
• interfere with professional judgement

3.4 Any attempt to do so is not binding on the Instructor.

4. Payment Terms

4.1 All lessons must be paid in advance.

4.2 No lesson is confirmed until payment is received.

4.3 Block bookings:

• must be paid in full
• are non-refundable once commenced, except at Instructor discretion

4.4 Payment made to any third party does not:

• override these terms
• create refund entitlement
• alter the Instructor’s payment conditions

5. Cancellation Policy

5.1 A minimum of 48 hours’ notice is required.

5.2 Late cancellations:

• result in loss of lesson fee
• lesson time is forfeited

5.3 This applies regardless of:

• personal circumstances
• third-party involvement
• work schedules or availability

6. Refund Policy (Legally Hardened)

6.1 Refunds are not automatic and are issued solely at the Instructor’s discretion.

6.2 Refunds will not be issued for:

• completed lessons
• missed lessons
• late cancellations
• change of mind or loss of motivation

6.3 Where a third party requests a refund:

The Instructor is not bound by such request unless a clear breach of duty is proven.

7. Nature of Tuition

7.1 Driving instruction is a structured learning process.

7.2 Progress depends on:

• pupil engagement
• consistency
• physical and mental readiness

7.3 Fatigue, lack of focus, or irregular availability may:

• slow progress
• extend training duration

8. Lesson Conditions

8.1 Pupils must:

• be fit to drive
• not be under alcohol, drugs, or excessive fatigue

8.2 Lessons may be terminated immediately if safety is compromised.

8.3 No refund is issued in such cases.

9. Professional Conduct

9.1 Respectful behaviour is required at all times.

9.2 The Instructor may withdraw services for:

• abusive behaviour
• unsafe conduct
• non-compliance

10. Driving Test & Vehicle Use

10.1 Use of the Instructor’s vehicle is entirely at the Instructor’s discretion.

10.2 The vehicle may be refused if:

• the pupil is not test-ready
• safety concerns exist

10.3 No third party or pupil may override this decision.

11. Instructor Independence

11.1 The Instructor operates as an independent professional.

11.2 The Instructor is not:

• employed by
• controlled by
• or legally bound to

any third-party provider.

11.3 The Instructor is not responsible for:

• promises made by third parties
• course timelines advertised elsewhere
• availability of tests

12. Liability

12.1 The Instructor is not liable for:

• test outcomes
• DVSA delays
• third-party actions
• pupil performance

12.2 Liability is limited to:

• direct loss caused by proven negligence

13. Complaints Procedure

13.1 Complaints must be raised directly with the Instructor within 72 hours.

13.2 Complaints raised solely via third parties:

• are not considered formal notice
• do not create liability

14. Entire Agreement

14.1 These Terms constitute the entire agreement between Instructor and Pupil.

14.2 No external terms shall override this Agreement unless:

• agreed in writing by the Instructor

15. Legal Enforcement

15.1 These Terms are governed by English law.

15.2 If any clause is unenforceable:

• the remainder remains valid
