Third-Party Referral Terms of Business

Effective Date: May 2026

These Terms apply where a pupil is referred to Skill4Life Driver Training by a third-party company, broker, referral platform, lead-generation provider, driving school, or instructor network.

1. Contractual Relationship

Upon commencement of tuition with Skill4Life Driver Training, the contractual relationship for all driving tuition services exists solely between the pupil and Skill4Life Driver Training.

Any agreement between the pupil and a third-party referral company relates only to the referral, booking, finance, administration, or marketing services supplied by that third party.

Skill4Life Driver Training is not responsible for representations, guarantees, timelines, or promises made by third parties unless confirmed directly in writing by Skill4Life Driver Training.

2. Supremacy of Instructor Terms

Once tuition commences, these Terms of Business supersede any conflicting third-party policies or terms relating to:

• lesson delivery
• cancellations
• refunds
• lesson scheduling
• practical test preparation
• vehicle use
• instructor conduct
• professional judgement
• tuition structure

Where any conflict exists between Skill4Life Driver Training Terms and third-party terms, Skill4Life Driver Training Terms shall prevail regarding all tuition services delivered by the instructor.

3. Independent Professional Status

Skill4Life Driver Training operates as an independent DVSA Approved Driving Instructor (ADI) business.

No third party may direct, interfere with, or override professional decisions relating to:

• road safety
• lesson structure
• pupil progress
• driving standards
• readiness for test
• use of the tuition vehicle

Professional decisions are made solely in accordance with DVSA standards, road safety obligations, and the instructor’s professional judgement.

4. Payments and Financial Responsibility

Any monies collected by a third party before instructor allocation remain the responsibility of that third party unless expressly transferred to Skill4Life Driver Training.

Skill4Life Driver Training accepts responsibility only for monies directly received by the instructor.

The instructor shall not be liable for:

• third-party administration fees
• finance agreements
• booking fees
• broker commissions
• test booking charges retained by third parties
• refunds relating to services not personally delivered by the instructor

5. Refund Policy

Refunds relating to tuition delivered by Skill4Life Driver Training remain entirely at the instructor’s discretion unless otherwise required by law.

Refunds will not normally be issued for:

• completed lessons
• late cancellations
• missed lessons
• lessons forfeited through pupil non-attendance
• lessons affected by pupil fatigue, lateness, or lack of preparation

Third parties may not impose refund demands, deductions, repayment obligations, or chargebacks against Skill4Life Driver Training without the instructor’s written agreement.

6. Lesson Cancellations and Attendance

A minimum of 48 hours’ notice is required to cancel or rearrange a lesson unless otherwise agreed in writing.

Late cancellations or missed lessons will normally result in the full lesson fee being charged.

Pupils are expected to arrive fit, alert, medically safe, and legally entitled to drive.

Lessons may be terminated immediately where the instructor believes continuation would create a safety risk.

7. Practical Test Vehicle Use

Use of the instructor’s tuition vehicle for a practical driving test remains entirely at the instructor’s professional discretion.

No third party may guarantee:

• use of the vehicle
• test readiness
• test attendance
• likelihood of passing

If the instructor believes the pupil has not reached a safe and consistent driving standard, use of the vehicle may be declined.

8. Complaints and Disputes

Any concerns regarding tuition should first be raised directly with Skill4Life Driver Training.

Third-party companies or networks may not determine liability, fault, refunds, or professional misconduct without allowing the instructor a reasonable opportunity to respond.

Skill4Life Driver Training reserves the right to reject complaints deemed:

• vexatious
• abusive
• retaliatory
• unsupported by evidence

9. Limitation of Third-Party Authority

No third party shall hold authority to amend, waive, vary, reinterpret, or override these Terms unless expressly agreed in writing by Skill4Life Driver Training.

No employee, agent, broker, or platform representative may make verbal assurances on behalf of Skill4Life Driver Training unless confirmed in writing by the instructor.

10. Data Protection

Personal data shared with Skill4Life Driver Training shall be handled in accordance with UK GDPR and used solely for the administration and delivery of driving tuition services.

Data supplied by third parties shall not be used outside legitimate instructional purposes.

11. Acceptance

By undertaking tuition with Skill4Life Driver Training following referral from a third party, the pupil acknowledges and accepts these Terms of Business.

Digital acceptance via text message, WhatsApp, email, booking confirmation, lesson attendance, or payment shall constitute acceptance of these Terms under the Electronic Communications Act 2000.
