Electronic Pupil Vehicle Use Agreement

Driving Tuition Conducted in a Pupil-Owned Vehicle

IMPORTANT NOTICE

This agreement applies where driving tuition is conducted in a pupil-owned vehicle which may not be fitted with dual controls or an auxiliary braking system.

Please read this document carefully before confirming acceptance electronically.

Electronic acknowledgment by WhatsApp, SMS, email, or other written electronic communication shall constitute acceptance of this agreement and shall carry the same legal effect as a handwritten signature under applicable laws of England and Wales, including the Electronic Communications Act 2000.

1. Driver Responsibility

I acknowledge and understand that during all lessons conducted in my own vehicle:

• I remain the legal driver and person in control of the vehicle at all times.
• I retain responsibility for:
  • steering,
  • braking,
  • acceleration,
  • observations,
  • speed management,
  • positioning,
  • and compliance with all road traffic laws and Highway Code obligations.

I understand that the instructor is acting in a supervisory, coaching, and instructional capacity only.

2. Absence of Dual Controls

I acknowledge that my vehicle may not be fitted with:

• dual controls,
• an auxiliary braking system,
• or other instructor intervention systems.

I understand that the instructor may therefore be unable to physically intervene to prevent an incident.

3. Vehicle Condition & Roadworthiness Declaration

I confirm that the vehicle used for tuition:

• is roadworthy;
• is maintained in a safe mechanical condition;
• complies with all applicable road traffic legislation;
• has correctly functioning brakes, steering, mirrors, tyres, seatbelts, lights, and indicators;
• holds a valid MOT certificate where legally required;
• is taxed;
• and is legally insured for road use.

I agree to immediately disclose:

• warning lights,
• defects,
• mechanical faults,
• accidents,
• recalls,
• tyre damage,
• or any issue affecting legality or safety.

4. Insurance Declaration

I confirm that:

• valid motor insurance is in force for the vehicle;
• the insurance permits supervised driving practice;
• and where applicable, permits professional driving tuition.

I understand that:

• my own motor insurance remains the primary insurance covering the vehicle;
• and the instructor’s public liability insurance is not a substitute for motor insurance covering the vehicle.

5. Medical Fitness & Legal Eligibility

I confirm that:

• I hold the correct licence entitlement;
• I meet DVLA medical fitness requirements;
• I am not knowingly impaired through illness, fatigue, medication, alcohol, or drugs;
• and I will immediately disclose any medical condition or treatment which may affect safe driving.

6. Instructor Discretion & Safety Authority

I understand and accept that the instructor may refuse, suspend, postpone, or terminate any lesson where, in the instructor’s professional opinion:

• the vehicle is unsafe;
• the conditions are unsuitable;
• I appear medically or mentally unfit to drive;
• I appear impaired by alcohol, drugs, medication, or fatigue;
• or continuing the lesson would create foreseeable risk.

No liability shall arise from the instructor exercising this discretion in the interests of safety.

7. Inherent Risk Acknowledgment

I understand and acknowledge that driving carries inherent risks including:

• collisions,
• third-party negligence,
• mechanical failure,
• emergency situations,
• unpredictable road conditions,
• and human error.

I acknowledge that no driving lesson can eliminate all risk.

8. Limitation of Liability

To the fullest extent permitted under English law:

Skill4Life Driver Training and the instructor shall not be liable for:

• normal vehicle wear and tear;
• clutch wear;
• tyre wear;
• mechanical breakdown;
• pre-existing defects;
• loss of earnings;
• missed appointments;
• indirect or consequential financial losses;
• or damage arising from inaccurate or incomplete information supplied by the pupil.

Liability may also be reduced or excluded where loss or damage arises wholly or partly from:

• defective vehicle condition;
• inadequate insurance;
• failure to follow instruction;
• unlawful conduct;
• reckless behaviour;
• or undisclosed defects.

9. Compliance With Instruction

I agree:

• to comply with all lawful and reasonable instructions given by the instructor;
• not to use a mobile phone whilst driving unless legally permitted;
• and not to engage in dangerous, aggressive, abusive, or reckless conduct.

10. Dashcams, CCTV & Electronic Records

I acknowledge that:

• lessons may be recorded by dashcams, CCTV systems, telematics systems, or electronic devices for:
  • safety,
  • insurance,
  • incident investigation,
  • legal protection,
  • and training purposes.

Such recordings and electronic communications may be disclosed where legally necessary to:

• insurers,
• solicitors,
• police,
• courts,
• DVSA,
• or regulatory authorities.

11. Electronic Acceptance

I acknowledge and agree that confirmation provided electronically by:

• WhatsApp,
• SMS,
• email,
• or other written electronic communication

shall constitute valid acknowledgment and acceptance of this agreement.

12. Legal Compliance

Nothing within this agreement excludes or limits liability:

• for death or personal injury caused by negligence;
• fraud or fraudulent misrepresentation;
• or any liability which cannot lawfully be excluded under English law.

13. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute shall fall under the jurisdiction of the English courts.

Electronic Confirmation Procedure

After reading this document in full, please reply with:

“I confirm”

By sending this confirmation electronically, you acknowledge that:

• you have read and understood this agreement;
• the information provided is accurate;
• and you voluntarily accept these terms prior to undertaking driving tuition in your own vehicle.
